Levv is a gentle, intimate daily ritual designed exclusively for you and your beloved plants. This agreement outlines the terms and conditions that govern your use of the Levv mobile application (the "App") and all associated services, created to nurture your plant care journey while prioritizing your calm and mental well-being. Levv is built with a core philosophy of simplicity, privacy, and intentionality—free from the noise of social media, unnecessary notifications, and external distractions. By accessing, downloading, or using the Levv App, you acknowledge that you have read, understood, and agree to be bound by this User Agreement, as well as our Privacy Policy (available for review at the contact details below).
2.1 Eligibility: You must be at least 13 years of age to use Levv. If you are under 18 (or the age of majority in your jurisdiction), you may only use the App with the consent and supervision of a parent or legal guardian, who will be responsible for your compliance with this agreement.
2.2 Account-Free Access: Levv is designed for instant, private use—no account creation, login credentials, or personal registration is required to access the core features of the App. All your plant care data, notes, photos, and videos are stored locally on your device by default, eliminating the need for account management and ensuring your privacy remains protected at every step.
2.3 Device Responsibility: You are solely responsible for maintaining the security of your mobile device, including passcodes, biometric locks, and physical device safety. Levv cannot be held liable for unauthorized access to the App resulting from compromised device security, lost or stolen devices, or inadequate device protection measures.
4.1 Your Content: All content you create and store within Levv—including care logs, notes, photos, videos, and exported cards—remains the exclusive property of you. Levv claims no ownership rights to your personal content, and all such content is stored solely on your device (as outlined in our Privacy Policy). You retain full control to delete, export, or modify your content at any time.
4.2 Levv’s Intellectual Property: The Levv App, including its design, graphics, logos, icons, text, code, algorithms, and all original content provided by Levv (excluding your personal content), is the intellectual property of Levv and its licensors. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with this agreement.
4.3 Prohibited Use: You may not copy, distribute, modify, create derivative works of, or commercially exploit any part of the Levv App or its intellectual property without prior written permission from Levv. This includes but is not limited to reselling the App, using it for commercial services, or reproducing its design for other applications.
5.1 Local Storage: Levv stores all your personal content locally on your mobile device’s internal storage. The storage capacity of your content is limited by the available storage space on your device. Levv recommends regularly backing up your content to external storage (e.g., cloud services, computer) to prevent data loss, though Levv does not provide automatic cloud backup for your content.
5.2 Data Deletion: If you uninstall the Levv App, all content stored locally on your device will be deleted, unless you have exported or backed up the content to an external location. Levv is not responsible for recovering content that is deleted due to app uninstallation, device storage clearance, or device damage.
5.3 App Updates: Levv may release periodic updates to the App to improve features, fix bugs, or enhance performance. These updates may modify local storage requirements or data handling practices, but all changes will be designed to preserve your existing content where possible. You authorize Levv to install such updates automatically on your device, or you may choose to update manually through your app store.
Levv is built with privacy as a foundational principle. We do not collect, transmit, or share your personal content or usage data with third parties by default. All data remains on your device, and we only process data in ways that align with our Privacy Policy. You can learn more about how data is stored and protected on your device by reviewing our Privacy Policy, which is incorporated into this agreement by reference.
7.1 Voluntary Termination: You may stop using the Levv App at any time by uninstalling the app from your device. Termination of use does not affect your ownership of your personal content (stored locally on your device).
7.2 Levv’s Right to Suspend: Levv may suspend or restrict your access to the App if we determine that you have violated this User Agreement, including but not limited to abusive use of the App, infringement of intellectual property rights, or illegal activity related to the App. We will attempt to notify you of such suspension prior to taking action, where feasible.
7.3 Permanent Discontinuation: Levv reserves the right to discontinue the App or its services at any time, with or without prior notice. In the event of discontinuation, we will make reasonable efforts to guide you in exporting your personal content from the App before discontinuing services.
Levv is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the App will be uninterrupted, error-free, or free from harmful components, nor do we guarantee the accuracy, completeness, or reliability of any content or features within the App. Levv shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the App, including but not limited to data loss, device damage, or emotional distress related to plant care tracking or growth ring visualizations. The mood-inspired growth rings and plant growth visualizations are for motivational and reflective purposes only and do not constitute professional horticultural advice.
Levv may update this User Agreement from time to time to reflect changes in the App’s features, data practices, or legal requirements. We will notify you of material changes by posting the updated agreement within the App or through other reasonable communication channels (e.g., app store updates). Your continued use of the App after the effective date of the updated agreement constitutes your acceptance of the revised terms.
